“Sanctions imposed on organizations that tested caulk taken from California schools without permission for chemicals known as PCBs should be reconsidered, the Ninth Circuit ruled Friday.
There are “insufficient grounds” for finding that the testing was done in bad faith, even if it was done before America Unites for Kids and Public Employees for Environmental Responsibility sued state officials to force the removal of polychlorinated biphenyl, or PCBs, from schools, the U.S. Court of Appeals for the Ninth Circuit said.”
