Kevin Bell, staff counsel for Public Employees for Environmental Responsibility, said agencies haven’t been following the standard either.
“It really has become a box-checking exercise,” Bell told E&E News. “I don’t think this memo helps too much with that.”
Bell mentioned Garland’s memo also said agencies should post records online proactively and systemically, yet it didn’t say how to ensure those records posted on the Internet are compliant with federal law that they should be accessible to people with disabilities.
“These are good ideas, but it doesn’t say necessarily how to implement them,” Bell said. “DOJ doesn’t provide any guidance on that.”
