PRISON WHISTLEBLOWER TESTIFIES

Atwater – Safety Manager, Leroy Smith, will be cross-examined tomorrow concerning the Federal Bureau of Prison’s computer recycling program that is exposing staff and inmates to toxic levels of hazardous metals.

Administrative Judge Jeremiah Cassidy will be deciding whether to allow Smith=s whistleblower retaliation case to proceed, pending the Bureau=s cross-examination of Smith, and testimony from three additional agency witnesses. The Bureau must prove by clear and convincing evidence that the agency would have taken the same retaliatory and harassing actions it took against Smith, even if Smith had not blown the whistle on the toxic recycling program.
