Bob Sussman, an attorney representing intervening plaintiff groups responsible for the initial independent testing, the Center for Environmental Health and Public Employees for Environmental Responsibility, argued that the rule covers both impurities and byproducts.
Sussman filed a motion for injunctive relief, which asks the court to bar production, and the U.S. concurred with the request but asked the judge to first rule on the issue of liability.
Sussman has led the groups’ efforts to force a pause in Inhance’s production, which fluorinates an estimated 200 million containers per year, which often hold products in bulk like pesticides or cleaning supplies.
